Super Squad Terms & Conditions

Introduction
Welcome to the Super Squad Referral Program, Superbrew's affiliate and referral program. This program is designed to reward our valued affiliates for referring new customers to our products and services. By participating in this program, you agree to comply with these Terms and Conditions. Please read them carefully.
Eligibility
To be eligible for participation in the Super Squad Referral Program, applicants must be 18 years or older and have a valid Indian bank account, UPI ID, or other active method of payment reception.
Superbrew reserves the right to approve or reject any application to the program at its sole discretion.
Program Participation
Affiliates will receive a unique referral code and/or link to share with potential new customers.
Commissions are earned on qualifying sales that are directly attributable to the affiliate's referral code or link.
Affiliates are responsible for ensuring their referral methods comply with all applicable laws and regulations, including the disclosure requirements of the Advertising Standards Council of India (ASCI) and the Central Consumer Protection Authority (CCPA).
Commission and Payments
Commission rates are subject to change at Superbrew's discretion. Affiliates will be notified of any changes.
Minimum Payout Threshold: Commissions will only be paid out once an affiliate's account balance reaches ₹5,000. Balances below this threshold will be carried forward to subsequent periods until the minimum is reached.
Superbrew retains sole discretion in determining whether to process commission payouts. We reserve the right to delay, withhold, or deny payment for any reason, including but not limited to suspected fraud, terms violations, or quality concerns.
Unless agreed upon prior to sharing of referral link and code, all commission payouts will be issued as store credit to be used at superbrew.com.
Payments of commissions are contingent upon the collection of funds from the referred customer. Returned or canceled sales will result in the deduction of the corresponding commission from the affiliate's balance.
All commissions are subject to review and verification by Superbrew. This process is to ensure the integrity of the Affiliate Marketing Program and may include the delay or withholding of payment while an investigation is conducted.
Commissions deemed to be earned through fraudulent, illegal, or overly aggressive, questionable sales or marketing methods will be voided.
Payment processing may take up to 30 business days after the minimum payout threshold is reached and all verification processes are complete. All payouts are net of any tax deducted at source (see Tax Responsibilities).
Coupon and Deal Sites
Posting on coupon and deal websites, such as GrabOn, CouponDunia, or Honey, is strictly prohibited. Affiliates found to be sharing or allowing their codes to be posted on such sites will be subject to immediate termination from the program and forfeiture of any pending commissions.
Affiliates are encouraged to report any unauthorized use of their codes to Superbrew for investigation.
Prohibited Activities
Running paid ads on social or search platforms such as Meta (Facebook/Instagram), Google, and YouTube is strictly prohibited. Affiliates found to be promoting their codes via paid media will be subject to immediate termination from the program and forfeiture of any pending commissions.
Affiliates may not engage in the following activities:
- Bidding on Superbrew brand terms or trademarked terms in paid search campaigns (Google Ads, Bing Ads, etc.)
- Creating misleading or false advertising regarding Superbrew products
- Using spam or unsolicited communications (including bulk WhatsApp, SMS, or email) to promote referral links
- Impersonating Superbrew or representing themselves as official representatives without authorization
- Self-referrals to artificially inflate commissions
- Using referral links on cashback sites or apps (such as CashKaro or similar) without prior written approval
Disclosure and Advertising Compliance
Affiliates must clearly disclose their material connection with Superbrew in accordance with the ASCI Guidelines for Influencer Advertising in Digital Media and the CCPA's Guidelines for Prevention of Misleading Advertisements and Endorsements (2022).
Disclosures must be clear, prominent, and upfront — placed so they are noticed before or alongside the affiliate link (e.g., "#ad", "#collab", "#sponsored", "#SuperbrewPartner", or "I earn a commission from this link"). Labels must be in a language the audience understands and must not be buried among other hashtags.
Failure to comply with these disclosure requirements may result in immediate termination and forfeiture of commissions.
Product Claims and Representations
Affiliates may not make unsubstantiated health claims or medical claims about Superbrew products.
All product representations must be truthful and consistent with information provided by Superbrew, and must comply with the Consumer Protection Act, 2019 and applicable food safety/labelling regulations (FSSAI).
Affiliates should direct customers with specific health questions to consult healthcare professionals.
Intellectual Property
Affiliates may not alter any brand assets provided by Superbrew without prior written consent.
All promotional materials, including but not limited to images, logos, and slogans, must be used in a manner that is respectful and consistent with Superbrew brand guidelines.
Upon termination, affiliates must immediately remove all Superbrew content from their platforms and cease all promotional activities.
Brand Protection
Affiliates must maintain content quality standards that align with Superbrew's brand aesthetic and values.
Superbrew reserves the right to request removal of any content that does not meet brand standards or could be damaging to our reputation.
Tax Responsibilities
Affiliates are solely responsible for reporting and paying any applicable income tax on their commission earnings under the Income Tax Act, 1961.
Superbrew will deduct Tax Deducted at Source (TDS) on commission payments where required by law (e.g., under the provisions applicable to commission/brokerage) and will issue the corresponding TDS certificate (Form 16A).
Affiliates must provide a valid PAN. Failure to furnish a valid PAN may result in TDS being deducted at a higher rate as prescribed by law.
Affiliates who are registered under GST are responsible for any applicable Goods and Services Tax on their commission/services and may be required to raise a valid tax invoice. Affiliates are encouraged to consult a chartered accountant regarding their tax obligations.
Termination
Either party may terminate the affiliate relationship at any time with or without written notice.
Upon termination, the affiliate must cease all use of Superbrew branding, promotional materials, and referral links or codes.
Superbrew reserves the right to terminate affiliate accounts without notice for violations of these terms. Upon termination for cause, any pending commissions may be forfeited.
Affiliates who voluntarily terminate their account will receive payment of earned commissions only if the balance meets the minimum payout threshold at the time of termination.
Data and Privacy
Affiliates agree not to misuse any customer data accessed through the program.
All customer information must be handled in compliance with the Digital Personal Data Protection Act, 2023, other applicable privacy laws, and Superbrew's Privacy Policy.
Limitation of Liability
Superbrew will not be liable for indirect, special, or consequential damages, or any loss of revenue, profits, or data arising in connection with this Agreement or the Affiliate Program, even if we have been advised of the possibility of such damages. Our total liability to any affiliate shall not exceed the total commissions earned by that affiliate in the 12 months preceding the claim.
Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts at [City, e.g. Bengaluru].
Amendment
Superbrew reserves the right to update and change these Terms and Conditions from time to time without notice. Material changes will be communicated to active affiliates via email. Continued participation in the program after such changes shall constitute your consent to such changes.
Agreement
By participating in the Super Squad Referral Program, you agree to abide by these Terms and Conditions. You understand that violation of any terms may result in the termination of your participation in the program and forfeiture of any accrued commissions.
